Will you automatically get citizenship if you marry a Canadian?
Blog Article
You may not believe it, but it is in fact true that when someone from a developing nation marries a Canadian, people often think that one part of their motivation lies in seeking a better lifestyle. Many countries like Italy, Spain, Portugal, Brazil and United States of America have laws in place that allow individuals to get citizenship via marriage, but not in copyright!
In copyright, you cannot automatically become a citizen by marrying a Canadian. If you or your spouse wish to become a Canadian Citizen, then you have to follow the same steps as everyone. The first step lies in checking whether you are eligible for citizenship.
Are you eligible for Canadian Citizenship?
As per IRCC, to become a Canadian Citizen one must meet all the following criterions.
1)copyright
Your spouse can only help you by the means of spousal sponsorship program to become a copyright unless you are already one. This means that you must gain the status of ‘copyright’ before you apply for ‘Canadian Citizenship’.
Additionally, you also have to ensure that you are not,
under review for immigration or fraud reasons,
asked by Canadian officials to leave copyright, i.e, no removal order of your name exists,
having any conditions that are unfulfilled related to your PR status.
Please note that you do not need a valid PR card to apply for citizenship, you can also apply with an expired one. If you have more doubts like this, then connect with our Immigration lawyers Mississauga
2)Physical Presence
To qualify for Canadian citizenship, you must show a physical presence in copyright for 1,095 days (3 years) within the last 5 years before applying. This means that you need to go back 5 years from the date of your application and track your time carefully.
If you were in copyright as a temporary resident (like on a work or study permit), some of that time may count towards the 1,095 days. For instance, if you were studying in copyright for 3 years, then those 3 years will be counted as 1 towards this requirement.
3)Filing TAXES
You may have to file taxes for at least 3 years in copyright. This also falls within the 5-year window period explained above. First, you must find out if you are supposed to file taxes or not!
4)Language Skills
On the day you sign your citizenship application, you must demonstrate basic knowledge of English or French. This requirement ensures you can make informed decisions during the immigration process. The test by IRCC confirms your ability to participate in everyday conversations, follow simple directions, and instructions. Just the ability to answer questions, expressing yourself, and that you can articulate your thoughts and have knowledge of familiar words and phrases would be the key to pass this test.
Please note that this requirement is not applicable for people below 18 and above 54 years of age.
Your speaking and listening skills must be equivalent to Canadian Language Benchmarks (CLB) level 4 for English or Niveaux de compétence linguistique canadien (NCLC) level 4 for French. IRCC will assess your language proficiency through:
Reviewing the language proof submitted with your application.
Observing how well you communicate during any interactions with citizenship officials throughout the application process.
Evaluating your language level during a citizenship interview or test, if needed
What is Required from a Spousal Sponsor?
If your spouse in not a copyright, then you can help them gain that through the Spousal Sponsorship program. After they gain the PR status, they will become eligible to apply for Canadian Citizenship. However, before starting the process, it is essential to understand your obligations as a sponsor. Key requirements include:
Signing an undertaking: This is a legal commitment where you agree to financially support your spouse for three years, starting from the day they become a copyright. Please note that you should only sign this undertaking if you will never require any financial aid from the government to support your spouse. This is because whatever social assistance you receive, has to be eventually paid back to the government by you (some exemptions available).
Commitment to financial support: You must agree to provide financial support for your spouse for a specified period, even if your relationship ends. This includes covering basic needs like food, shelter, and healthcare. You should know that the ‘undertaking’ will not be affected in cases like:
the person you sponsor becomes a Canadian citizen,
you become divorced, separated or your relationship with the sponsored person breaks down,
you or the person you sponsor move to another province or country,
you have financial problems.
Meeting income requirements: In most cases, there is no minimum income requirement, except when sponsoring a dependent child with your spouse. Further you also have to show that you can provide basic needs for yourself, your spouse, and a dependent child (if applicable).
Living in copyright: To become a sponsor, you must be at least 18 years old and a Canadian citizen. Being a Canadian citizen the validity of your application does not depend on you residing within copyright, but you must demonstrate your plan to return to copyright with your spouse or partner when they immigrate. On the other hand, if you are a copyright, you are required to be living in copyright to sponsor your spouse.
